Article IV: Termination and Protection Provisions

Critical Protection Clauses
4.1 Justified Termination by Church
The Church may terminate this Agreement for cause, including but not limited to:
  • Moral failure or conduct inconsistent with biblical standards
  • Repeated failure to fulfill ministry responsibilities despite coaching and support
  • Failure to make measurable progress toward stated objectives after 18 months, provided the Church has fulfilled its support commitments under Article II, Section 2.3
  • Gross negligence or willful misconduct
Note: Termination for cause requires verification by Church Leadership Alliance that grounds exist and Church has fulfilled support obligations.
4.2 Severance Protection for Minister
If the Minister resigns or is terminated for reasons OTHER than those listed in Section 4.1, AND Church Leadership Alliance determines that:
  • The Church failed to provide agreed-upon support under Article II, Section 2.3, OR
  • The Church allowed congregational interference that prevented the Minister from accomplishing stated objectives, OR
  • The Church withdrew support for the agreed-upon objectives mid-contract
THEN the Church shall pay the Minister severance calculated as: $5,000 base + (1-6 weeks of base compensation per year served), capped at $25,000 maximum, within 30 days of separation.
Severance Calculation Formula:
  • Base: $5,000 (covers immediate relocation/transition expenses)
  • Years 1-2: Add 1 month (4 weeks) of base compensation per year served
  • Years 3-5: Add 5 weeks of base compensation per year served
  • Maximum Cap: $25,000 total severance
  • Note: Specific severance amounts may be negotiated during contract creation based on individual circumstances
Example: Minister earning $70,000/year base compensation
  • After 1 year: $5,000 + (4 weeks × $1,346) = $10,384
  • After 2 years: $5,000 + (2 years × 4 weeks × $1,346) = $15,768
  • After 3 years: $5,000 + (3 years × 5 weeks × $1,346) = $25,000 (capped)
  • After 5 years: $25,000 (capped - see contract renewal terms below)
This severance is designed to:
  • Provide immediate financial stability during transition to a new ministry position
  • Compensate for relocation costs and family disruption
  • Scale appropriately with length of service and family investment in the community
  • Remain affordable for churches while protecting ministers
  • Incentivize the Church to honor its commitments and protect the Minister from congregational politics
4.3 Voluntary Resignation by Minister
The Minister may resign at any time with 90 days written notice. If resignation occurs due to Church failure to uphold this Agreement (as determined by Church Leadership Alliance), severance provisions in Section 4.2 apply.
